Copyright ©
My artwork and designs both physical and presented electronically is automatically protected by copyright in Australia under the Copyright Act 1968. All my artworks displayed on this site have a watermark with the copyright symbol © and my logo.
I hold the right to reproduce, publish, communicate or broadcast my works(i.e internet).
To make use of my art outside that of personal ownership and private display you would need to contact me to negotiate whether payment is required. Get my permission agreement in writing.
I as the owner of my original art creations, permission is required to:
• reproduce it (e.g. by photographing, photocopying, copying by hand, filming, scanning into digital form or printing from a digital file)
• publish it (e.g. by making copies available for sale), and
• communicate the work to the public (e.g. by uploading it to the internet, emailing or broadcasting it). This applies to all outlets on commerce engines like AliExpress, Temu, Alibaba, Instagram, Facebook etc
If you purchase my art do not need your permission to exhibit the original version of my work (e.g. in a gallery) but I’d appreciate a credit notice to me as the artist. As the copyright owner I have the right to prevent the work being put on the internet (even if it was uploaded in a way that could only be looked at and not printed off) because this would be both a “reproduction” and a “communication” of the work.
If you use myart work you need to attribute it to me, and to and avoid treating my work in offensive ways. This is because of obligations in the Copyright Act relating to moral rights. For more information see our fact sheet Moral Rights.
Protection overseas
As a result of international treaties such as the Berne Convention, Australian artistic works are protected by copyright in most other countries.
Commissioned works
I will to set out the terms and conditions of the agreement in writing relating to the commissioned artwork.

Royalty on resale
The resale royalty right for visual artists commenced in Australia on 9 June 2010. The scheme provides an additional income stream for visual artists and their heirs. It was introduced in recognition of the fact that, while other creative works such as books and music often generate income streams (royalties) over a period of time, in most cases visual artists only realise value from the principal sale of their artwork, and not from other royalty income streams.
The royalty applies to original ‘works of visual art’ that are either created by an artist or group of artists or produced under the authority of an artist or group of artists. The term ‘works of visual art’ includes (but is not limited to): digital artworks, drawings, multimedia artworks, paintings, photographs, pictures, prints.
For a resale royalty to be payable, a minimum sale price of $1,000.00 (including GST, but not including any buyer’s premium or other tax) must be paid by the purchaser. Any sales for less than $1,000.00 will not attract the royalty. The royalty is 5% of the resale price (including any GST applicable on the sale). The royalty itself does not attract GST. This means that no GST is payable in addition to the royalty.
